Old age and mental impairment

Many of us have the worry of ageing relatives and face the
prospect of difficult decisions relating to residential care, or
physical and mental ill health. There are important legal
issues to consider in these cases, including Power of
Attorney. Barnes Marsland Personal can provide sensitive legal advice on these difficult issues.

Lasting Powers of Attorney

Over 700,000 people in the UK are suffering from some type of dementia and Jacqui Miles and her specialist team at Barnes Marsland Solicitors knows how tough this can be for families. You need to consider preparing for this possibility now, whilst you have capacity and appoint an Attorney by way of a Lasting Power of Attorney or LPA.

If you feel friends or family may not be suitable, Barnes Marsland can be appointed as an Attorney and manage your affairs for you in your best interests, should the need arise. This can be an excellent way of ensuring that a person can remain in their own home for as long as possible, as Barnes Marsland make all the arrangements necessary.

Creating a Lasting Power of Attorney (LPA) while you are still in total control of all your faculties makes a lot of sense. Once capacity is lost, an LPA is not always possible and formal applications must be made by your family to the Court of Protection.

Lifetime Management

For the elderly and frail, living an independent life in their known home is often the main priority. This option is often more realistic with an attorney appointed to manage all of the financial and administrative affairs on behalf of the clients. By appointing a specialist firm of solicitors rather than an friend or family member, the client knows that the firm is obliged by the Mental Capacity Act  and Solicitors Regulation Authority to act in the best interests of the client at all times.
